These Terms of Service govern use of Hachi, a Discord bot operated by FearlessKenji in North Carolina, United States. By adding Hachi to a Discord server or using Hachi commands, you agree to these Terms.
If you do not agree to these Terms, do not use Hachi and remove it from your server.
Hachi provides Discord bot features for Twitch and Kick live notifications, streamer configuration, birthday reminders, reaction roles, and related server utilities.
Hachi is not affiliated with, endorsed by, or sponsored by Discord, Twitch, Kick, GitHub, or other third-party services linked by the bot unless expressly stated otherwise.
You may use Hachi only if you are allowed to use Discord and comply with Discord’s Terms of Service, Community Guidelines, Developer Terms, Developer Policy, and applicable server rules.
If you add Hachi to a server, you represent that you have permission to do so and that using Hachi does not violate your server’s rules or applicable law.
Server owners and administrators are responsible for how Hachi is configured and used in their Discord servers. This includes command permissions, notification channels, ping roles, streamer settings, birthday settings, reaction-role panels, and permissions granted to the bot.
Server owners and administrators are responsible for making sure their server’s use of Hachi complies with applicable laws, Discord rules, these Terms, and their own server rules.
You agree not to:
FearlessKenji may restrict, ban, or remove users or servers from Hachi at any time to protect the bot, users, Discord communities, or third-party services.
Administrators are responsible for streamer names, notification settings, Discord invite URLs, channel choices, role choices, and other configuration they provide to Hachi.
Hachi may post live notifications and update notification messages based on information from Twitch, Kick, Discord, and server configuration. Stream status, channel data, and notification timing may be delayed, incomplete, inaccurate, or unavailable.
Users are responsible for any birthday information they choose to save with Hachi. Hachi stores birth month and day only, not birth year.
Birthday lists, reminders, and birthday-day posts may be visible to members of the relevant Discord server depending on channel permissions and server configuration. Do not use the birthday feature to submit private, confidential, or sensitive information.
Administrators are responsible for reaction-role panel titles, descriptions, role labels, emojis, images, and other content they provide to Hachi.
Hachi may add or remove Discord roles when users interact with reaction-role panels. Server owners and administrators are responsible for making sure Hachi’s role permissions and configured role panels are appropriate for their server.
Hachi provides stream, server utility, and role-management features for convenience. Information from Discord, Twitch, Kick, or server configuration may be incomplete, outdated, inaccurate, delayed, or unavailable.
You are responsible for verifying information before relying on it.
Hachi depends on Discord and may use Twitch and Kick APIs. Hachi may also link to or be documented through third-party services, including GitHub Pages.
Your use of third-party services is governed by those services’ own terms and privacy policies. FearlessKenji is not responsible for third-party content, policies, availability, accuracy, security, or privacy practices.
If Hachi source code is made available in a repository, that source code may be governed by the license included with the repository. These Terms govern use of the hosted Hachi bot service. They do not replace the repository’s open source license for code covered by that license.
Hachi’s data practices are described in the Privacy Policy. By using Hachi, you acknowledge that Hachi processes information as described there.
Hachi is provided as available. Features may be changed, limited, suspended, or discontinued at any time without notice.
Hachi may be unavailable because of maintenance, bugs, Discord API changes, Twitch or Kick outages, hosting issues, permission changes, rate limits, or other reasons.
To the fullest extent permitted by law, Hachi is provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory, or otherwise. This includes implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and security.
To the fullest extent permitted by law, FearlessKenji will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, service interruption, missed notifications, incorrect notifications, role assignment issues, birthday posting issues, or Discord server issues arising from or related to Hachi.
To the fullest extent permitted by law, FearlessKenji’s total liability for any claim related to Hachi will not exceed the greater of 100 US dollars or the amount you paid directly to FearlessKenji to use Hachi in the 12 months before the claim.
You agree to defend, indemnify, and hold harmless FearlessKenji from claims, damages, liabilities, losses, and expenses arising from your use of Hachi, your server’s configuration of Hachi, your content, your violation of these Terms, or your violation of law or third-party rights.
You may stop using Hachi at any time. Server owners or administrators may remove Hachi from their Discord server at any time.
FearlessKenji may suspend or terminate access to Hachi for any user or server at any time, with or without notice, including for violations of these Terms, abuse, security risks, or operational reasons.
These Terms are governed by the laws of the State of North Carolina and applicable United States law, without regard to conflict-of-law rules.
These Terms may be updated from time to time. The updated version will be posted on this page with a new “Last updated” date. Continued use of Hachi after changes means you accept the updated Terms.
